Miscellaneous Compliance (2.05.6(5), 4.02, 4.12, 4.19, 4.21, 4.28, 4.30) <br />No problems were identified with respect to the requirements of these sections <br />such as signs and markers, surface coal mining next to underground workings, <br />slides, facilities not at or near the mine site, etc. <br />The proposed operation is in compliance with the requirements of this section. <br />XXV. Operations on Land Subject to Limitations or Prohibitions (2.03.7, 2.10) <br />The Division finds, pursuant to the finding required by 2.07.6(2)(d), that the <br />permit area of the proposed operation is not within: <br />a. an area designated unsuitable for surface coal mining operations, <br />b. an area under study for designations as unsuitable for surface coal <br />mining operations, <br />c. any lands subject of prohibitions or limitation under Rule <br />2.07.6(2)(d)(iii), and <br />d. 300 feet, measured horizontally, of any occupied dwelling. <br />The Roadside mine is located within 100 feet of the outside right-of-way of <br />Interstate 70. This is allowed by 2.07.6(2)(d) since the mine was in <br />existence prior to August 3, 1977. <br />The proposed operation is in compliance with the requirements of this section. <br />XXVI. Demonstration that Surface Coal Mini <br />The Division finds, pursuant to Rule 2.07.6(2)(b), based on information in the <br />application and from all available sources, that surface coal mining and <br />reclamation operations can be feasibly accomplished under the Mining and ~ <br />Reclamation Plan contained in the application. <br />The operation is in compliance with the requirements of this section. <br />XXVII. Compatibility with Anticipated Adjacent Operations (2.07.6(2)(1)) <br />Pursuant to Rule 2.07.6(2)(1), the Division finds that the proposed operations <br />will not be inconsistent with other operations anticipated to be performed in <br />areas adjacent to the proposed permit area. <br />The operation is in compliance with the requirements of this section. <br />-38- <br />
