Proposed Decision <br />The Colorado Mined Land Reclamation Division proposes to approve, with <br />stipulations, an application for renewal of a valid existing permit. <br />The application was submitted by Colorado Yampa Coal Company for the <br />Energy Mine No. 3. This decision is based on a finding that the operations <br />will comply with all requirements of the Colorado State Program as found in <br />the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq.. <br />and the Regulations promulgated pursuant to the Act. If no request for a <br />formal hearing is made within thirty (301 days of the first publication of the <br />issuance of this proposed decision, then this decision becomes final. A valid <br />and viable reclamation bond is held by the Division at this time. The permit <br />application, all supporting documentation and any stipulations or conditions <br />will become a binding part of the permit... <br />The original stipulations I1-161 for the Energy Mine No. 3 permit have been <br />resolved. The details regarding stipulation resolution can be found in a <br />January 7, 1987 memorandum to the file, from Brent Anderson. The permit <br />renewal adequacy letter of September 15, 1989 also addresses stipulation <br />resolution. The following stipulation is hereby attached to the Energy Mine <br />No. 3 permit renewal approval: <br />Stipulation No: 17: <br />THE OPERATOR MUST SUBMIT A COMPLETE TECHNICAL REVISION WHICH PROVIDES AN <br />UPDATED DRAINAGE AND SEDIMENT CONTROL PLAN. THE REVISION Ml1ST INCLUDE A <br />REVISED DRAINAGE CONTROL MAP INCLUDING ACCURATE TOPOGRAPHIC INFORMATION, <br />ALL DRAINAGE CONTROL FEATURES, AND IT MUST ACCOUNT FOR ALL DISTURBED AREA <br />DRAINAGE. ALL PREVIOUS DRAINAGE CONTROL REVISIONS AND EXHIBITS MUST BE <br />CONSOLIDATED, AND INCORPORATED INTO THIS NEW REVISION. THE REVISION MUST <br />BE SUBMITTED NO LATER THAN DECEMBER 31, 1990. <br />-2- <br />
