Proposed Decision
The Colorado Mined Land Reclamation Division proposes to approve, with
stipulations, an application for renewal of a valid existing permit.
The application was submitted by Colorado Yampa Coal Company for the
Energy Mine No. 3. This decision is based on a finding that the operations
will comply with all requirements of the Colorado State Program as found in
the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq..
and the Regulations promulgated pursuant to the Act. If no request for a
formal hearing is made within thirty (301 days of the first publication of the
issuance of this proposed decision, then this decision becomes final. A valid
and viable reclamation bond is held by the Division at this time. The permit
application, all supporting documentation and any stipulations or conditions
will become a binding part of the permit...
The original stipulations I1-161 for the Energy Mine No. 3 permit have been
resolved. The details regarding stipulation resolution can be found in a
January 7, 1987 memorandum to the file, from Brent Anderson. The permit
renewal adequacy letter of September 15, 1989 also addresses stipulation
resolution. The following stipulation is hereby attached to the Energy Mine
No. 3 permit renewal approval:
Stipulation No: 17:
THE OPERATOR MUST SUBMIT A COMPLETE TECHNICAL REVISION WHICH PROVIDES AN
UPDATED DRAINAGE AND SEDIMENT CONTROL PLAN. THE REVISION Ml1ST INCLUDE A
REVISED DRAINAGE CONTROL MAP INCLUDING ACCURATE TOPOGRAPHIC INFORMATION,
ALL DRAINAGE CONTROL FEATURES, AND IT MUST ACCOUNT FOR ALL DISTURBED AREA
DRAINAGE.
