Y. Sealing of Drilled Holes and Underground Openings <br />1. The Division will require that each hole, well or other underground <br />opening be capped, sealed, backfilled, or otherwise properly <br />managed. (4.07.31. <br />VI. Use of Explosives <br />The applicant proposed to conduct blasting operations in the surface <br />mine area. According to Map No. 6, Mine Plan, no potentially <br />sensitive facilities are within 500 feet of the blasting area. The <br />applicant used a previously CMLRD approved scaled distance formula <br />to determine explosive weight and associated blast hole spacing <br />(see Exhibit 21, Volume 3 of permit application). <br />The applicant stated that the number of blast holes per delay would <br />be limited by the modified scaled distance equation so that the peak <br />particle velocity did not exceed the limit of 1 inch per second. <br />A11 warnings and access regulations were implemented by the <br />applicant. All blasting was conducted as announced in the blasting <br />schedule. A record of blasting design and of each shot was kept at <br />the mine office. <br />The Division finds that the blasting plans in the Energy Mine No. 3 <br />permit application conform with the requirements of this section. <br />2. The mine is now reclaimed; therefore, all blasting activities have <br />permanently ceased. <br />VII. Disposal of Excess Spoil <br />1. One permanent overburden pile exists at the south end of the mine. <br />The pile was completely constructed prior to enactment of the <br />Permanent Colorado Program. As such, the pile construction was <br />exempted from the requirements of 4.09.1. Specific documentation <br />regarding this exemption is located at Exhibit 26 of the permit <br />document. The operator remains responsible, however, for <br />achievement of successful revegetation of the pile, according to the <br />requirements of current regulations. <br />VIII.
