All stipulations not listed below <br />have been previously satisfied. <br />Stipulation No. 6 <br />The permittee will submit to the Division an annual hydrologic report. This report <br />shall include an analysis of all hydrologic data gathered during the year, an <br />assessment of the hydrologic impacts of mining during the year, and an assessment <br />of the projected hydrologic impacts of mining in the following year. This report shall <br />assess the impacts of mining on the quality and quantity of water in surface streams, <br />springs, ground water aquifers, mine inflow, and mine discharges. <br />Stipulation No. 21 <br />Bear Coal Company shall monitor both the operational and reclaimed configurations of <br />the portal assess road and portal facilities of the No. 3 Mine. Monitoring shall <br />continue on asemi-annual basis until two years following completion of the <br />reclamation of the portal access road and portal facility area. Results of the <br />monitoring shall be submitted to the Division within 30 days following completion of <br />each monitoring episode. <br />Stipulation No. 32 <br />The applicant shall continue to submit to the Division an annual report of inflows, <br />discharges and consumption of water within the mine. Amine workings map, <br />showing the source (fault, fracture, etc.), quantity, duration and quality of inflows, <br />shall only be required if there are measurable inflows to the mine during the year. <br />Records of water discharged from, consumed in, and imported to the mine will also <br />be included. The above information will be submitted regularly with the annual <br />hydrology report. <br />Stipulation No. 33 <br />Bear Coal Company will, before initiation of mining permitted by PR-01, secure a <br />signed coal lease agreement with ARCO granting Bear Coal Company the right to <br />mine coal in the B-Seam in the Ell SEl4 Section 18, T13S, R90W of the 6th P.M. <br />Right of entry onto the surface overlying this section must also be obtained. <br />Summary <br />The Review Process <br />The Bear Coal Company operations currently consist of one active underground mine (Bear <br />No. 31, and two inactive mines that have been reclaimed (Bear No. 1 and 2). The mining <br />operation is located approximately ten miles northeast of Paonia, Colorado, and <br />one-quarter mile east of Somerset, Colorado (Figure 1).
