Box AE <br />Paonta, Colorado 81428 <br />Re: Somerset Mine Stipulation No. 4 and 5 <br />Dear Mr. Watts: <br />DIVISIO N <br />The Division 1s in receipt of your February 9, 1984 letter which responded to <br />Stipulation No. 4 and 5 of the Somerset Permit. <br />Stipulation No. 4 to Somerset Permit C-022-81 reads as follows: <br />Stipulation No. 4 <br />WITHIN 120 DAYS OF PERMIT ISSUANCE U.S. STEEL SHALL SUBMIT A SUBSIDENCE <br />MONITORING MAP WHICH COMMITS TO THE INSTALLATIDN OF A CENTERLINE <br />SUBSIDENCE MONITORING MONUMENT ABOVE EACH ENTRY OF THE 5TH WEST MAINS. <br />Jim Pendleton of our staff reviewed the proposed subsidence monitoring program <br />you submitted. He indicated that your response satisfied the stipulation <br />requirements. <br />Stipulation No. 5 reads as follows: <br />Stipulation No. 5 <br />U.S. STEEL SHALL SUBMIT A DEMONSTRATION THAT THE PROPOSED POST-MINING <br />CONTOURS OF ALL AREAS FOR WHICH THEY HAVE APPLIED FOR A VARIANCE FROM <br />THE APPROXIMATE ORIGINAL CONTOUR RESTORATION REQUIREMENTS, WILL BE <br />STABLE WITH A STATIC FACTOR OF SAFETY OF 1.3 WITHIN 120 DAYS AFTER <br />PERMIT ISSUANCE. <br />The proposed final reclaimed configuration and stability analysis for the <br />backftlled area was reviewed by Phil Saletta and myself. Your submittal <br />presented a stable, practical final topographic configuration for those <br />reclaimed areas of the mine.
