L PROCEDURES AND SUbINL4RY OF THE REVIEW PROCESS <br />Flatiron Companies applied for a Phase II~and Phase ~ bond release under the Co <br />Surface Coal Mining and Reclamation Act following reclamation and completion of I <br />year liability at the Bourg Strip Mine. The mine is on private lands within Jackson C <br />Colorado. The legal description of the lands included within the permit area is: <br />SI/2, SE1/4 Section 7 and N1/2, NE1/4 Section 18, R9N, R78W, Jackson <br />Colorado <br />The Bourg Strip Mine has been in existence since July, 1980 and has operated <br />permit Nos. 79-125 and C-81-021 issued by the Colorado Mined Land Recla. <br />Board. Mining operations at the Bourg Strip Mine ceased in 1987 and the mine si <br />fully reclaimed. Of the original 173 acres permitted for disturbance, approximate <br />acres were disturbed. Backfilling and final grading were achieved on 29 acres kn~ <br />the East Dump in 1983. The bond was r uced <br />sixty percent from $536,000.00 to $214,400.00. A Phase II and III bond release r quest <br />was approved in April, 1996 for the Northgate Loadout. The bond liability was redu ed by <br />$3,839.00, but Flatiron Companies did not reduce the bond to reflect the decre se in <br />liability. <br />The application for final bond release was received by the Division on August 6, 999. <br />The application was deemed complete on September 9, 1999, after the Division re eived <br />proof of publication of the applicant's public notice. Flatiron Companies published once <br />of the bond release application in The Jackson County Star once weekly fo four <br />consecutive weeks, beginning August 5, 1999. Flatiron Companies also n tified <br />landowners within and adjacent to the mine permit area, and other interested pa ~es of <br />the application for bond release, as required by Rule 3.03.2(1). No comments, tten <br />objections, or requests for an informal conference regarding the bond release appli anon <br />were received by the Division. <br />The Division scheduled and conducted a bond release inspection on October 6, 1999. <br />Participating in the inspection were Scott Patten of the Flatiron Companies, Rand Pair <br />representing the Office of Surface Mining and Sandra Brown representing DMG. e site <br />inspection was conducted in accordance with Rule 3.03.2(2).
