Lochhead <br />E.ecuhve Durcior <br />Michael B Long <br />Dniann Duecmr <br />On June 27, 1994 the Division received your June 24, 1994 <br />correspondence regarding my response to Ten-Day Notice 93-020-370- <br />005. I would like to take this opportunity to respond to your <br />letter, and to inform you of our plans to resolve this matter. <br />In a letter to the Department of Interior dated February 14, 1994, <br />(copy attached) I indicated that our investigation into whether the <br />air shaft is responsible for lowering the water level in your well <br />was on-going. By internal correspondence dated June .6, 1994, I <br />informed Division personnel that I was prepared to issue Basin a <br />Notice of Violation regarding this matter. However, I also <br />indicated that I was amenable to allowing Basin and you time to <br />attempt to reach a mutually agreeable solution within a reasonably <br />short period, prior to issuing the Violation. Shortly thereafter, <br />I was informed that you had recently undergone major surgery and <br />were incapable of entering into such negotiations. Your June 24, <br />1994 correspondence indicates to me that you are interested in <br />finally bringing this matter to a close. Therefore, I anticipate <br />that you and Basin would soon enter into productive negotiations to <br />resolve this matter. <br />I would like to clarify two issues which you raise in your <br />correspondence. First, the Division has not represented to the <br />Department of Interior that we have entered into negotiations with <br />you regarding a replacement water supply, as you allege. In my <br />February 14, 1994 correspondence to Interior, to which you <br />apparently refer, I state that the Division has "...initiated <br />informal discussions with the mine operator ultimately aimed at <br />providing Mr. Tatum with an alternative water source or a <br />reconstructed well." and "The Division has initiated discussions <br />with the permittee in order to resolve this concern." You have <br />apparently misconstrued these statements to mean that we have <br />
