On June 27, 1994 the Division received your June 24, 1994
correspondence regarding my response to Ten-Day Notice 93-020-370-
005. I would like to take this opportunity to respond to your
letter, and to inform you of our plans to resolve this matter.
In a letter to the Department of Interior dated February 14, 1994,
(copy attached) I indicated that our investigation into whether the
air shaft is responsible for lowering the water level in your well
was on-going. By internal correspondence dated June .6, 1994, I
informed Division personnel that I was prepared to issue Basin a
Notice of Violation regarding this matter. However, I also
indicated that I was amenable to allowing Basin and you time to
attempt to reach a mutually agreeable solution within a reasonably
short period, prior to issuing the Violation. Shortly thereafter,
I was informed that you had recently undergone major surgery and
were incapable of entering into such negotiations. Your June 24,
1994 correspondence indicates to me that you are interested in
finally bringing this matter to a close. Therefore, I anticipate
that you and Basin would soon enter into productive negotiations to
resolve this matter.
I would like to clarify two issues which you raise in your
correspondence. First, the Division has not represented to the
Department of Interior that we have entered into negotiations with
you regarding a replacement water supply, as you allege. In my
February 14, 1994 correspondence to Interior, to which you
apparently refer, I state that the Division has "...initiated
informal discussions with the mine operator ultimately aimed at
providing Mr. Tatum with an alternative water source or a
reconstructed well." and "The Division has initiated discussions
with the permittee in order to resolve this concern." You have
