Bor 1821 <br />Colorado Springs, Colorado 80901 <br />,~~~ <br />~,1~ ~~-; <br />AEG t ~ 19 _. <br />tii t- `, 92 <br />:b1INER,~~ ~PVrv;,r <br />~CU`i ~, <br />Re: Culvert - GEC Strip Mine and Energy Fuels Coal, Inc. <br />Southfield Mine Permit Areas <br />Dear Mr. Corley: <br />I am responding to your letter of July 27, 1992, which was <br />addressed to me and which reiterated your earlier demand that <br />the culvert installed by Harrison western be removed. <br />In his letter to you dated July 22, 1992, Daniel Hernandez, <br />Senior Reclamation Specialist for the Division of Mined Land <br />Reclamation, stated that "the current location of the culvert <br />provides the best balance of both minimization of surface <br />disturbance and conformance with sediment control regulations." <br />He went on to note that, in the Division's opinion, any <br />alternative handling of the runoff "would create a significantly <br />larger disturbance [of adjacent undisturbed drainage] for no <br />appreciable increase in hydrologic continuity." <br />Your contention that the placement of the culvert constitutes a <br />"trespass" is, at best, difficult to understand. Energy Fuels, <br />having been notified by the Division of your concerns, obviously <br />does not share them inasmuch as it has chosen not to file a <br />complaint. You own all of the property involved and the public <br />record is replete with documentation of your longstanding <br />"dialogue" with the Division regarding your demands that the <br />Division push various reclamation activities on your property <br />forward. The work performed by Harrison Western clearly meets <br />with the Division's approval. <br />I am therefore unable to understand how the Corley Company has <br />been damaged in any way by the work in question and can only <br />conclude that there is no objective basis for your request that <br />the culvert be removed. <br />4860 Robb Street.
