Dear Mr. Routten:
We received your letter dated June 14, 1994, but there was no enclosure
of the field directive with construction specifications.
We have gone to the site to see the new road into the West Pit. We do
not believe that this road will last until Mr. Kessler can start work;
one rain will cause severe washing of the highwall on the road. In
addition to destroying the road, there will be destruction of the
reclamation being completed on the hill. We believe that the Division
has wasted money to pay for elimination of the original road and then
pay to cut another road into the reclaimed hill, particularly since the
second road leaves the exposed shale highwall.
In my last conversation with Energy Fuels, they are not satisfied with
the present status of the road below Chen's Hill. That road to too
narrow with no room to place a ditch to maintain the road. Runoff will
cause continual damage to the road and cross directly into their
sediment pond. The effect of the new road along Magpie Creek is still
another unknown added to the effect of the material that was recently
pushed down the hill to reduce the slope.
Finally, your statement regarding the source of funding the various
proiects in the West Pit is interesting. Perhaps you can inform me liow
you can alter the agreement to now say that Harrison Western funds will
by used for the drainage improvement and not erosion repair. I see
nothing arbitrary about the use of Harrison Western funds for erosion
repair within their prior area.
