Cat[any <br />Ailing Division Director <br />'Do ~t/ E-'uL~%a~ i > <br />In response to your verbal request, which you made during our December 1 ], 2002 telephone conversation, I <br />checked your permit file for the information you wanted. You had asked specifically whether your permitted <br />gravel pit was in compliance from this Division's perspective. As you know, I inspected the site on October 15, <br />2002, and sent you a report of that visit. There were no inspection topics noted as problems at that time. The site <br />appeared to be mined in accordance with the approved plan. A limited amount of reclamation was evident, along <br />the western highwall in particular. The reclamation bond you have posted is in the amount of $15,883, and until the <br />scheduled bond review is performed by this office in the near future, the amount is deemed to be adequate. <br />We discussed a few changes to the permit which you plan to apply for in the future. You asked if I was aware of <br />any "overlap" in the application requirements or respective jurisdictions between our agency and that of Conejos <br />County. My understanding is that there is no overlapping jurisdiction, and that, while there may be some <br />similarities in the permitting requirements, the State and the County permits are separate. This office does not base <br />its decisions upon provision of evidence of local government approval or the issuance of any type of use permit by <br />the county. <br />At this time, your permit is considered to be in compliance. I look forward to answering any further questions you <br />may have and to reviewing any proposed changes to your permit you might submit.
