May 17, 1999
must be in place prior to the issuance of the permit. This plan would have to
include a description of positive spill prevention efforts, provisions for spill
control, provide immediate corrective action including spill control and
restoration of affected resources, and include separate and speciSc techniques and
schedules fiur cleanup of spills on the mine site and other properties.
Additionally, under the Emergency Planning and Community Right-to Know Act
(EPCRA) (40 CFR Parts 370, 372) Arkins must make this information available
to the public.
Air Pollution - A large mine within a residential area would generate a large
volume of rurborne particulate matter. This presents a serious health hazard for
individuals whom suffer from respiratory ailments. Before the Colorado Division
of Mining and Geology can issue a new permit impacts on air quality must be
adequately addressed and the public must be allowed an opportunity to review
the compiled information.
Employee :iafety - A facility ofthe size that Arkins wants to create would present
numerous hazards to employees. Arkins must demonstrate to the citizens of the
State of Colorado and Arkins employees that a safe work environment would be
guaranteed. This information would be available to the public as a Occupational
Safety and :Health Administration (OSHA) Emergency and Fve Prevention Plan
(20 CFR Part 1910.38).
The aforementioned issues must be addressed sufficiently prior to the issuance of the
112 Mining Permit. Lf these issues can not be addressed and the public is not allowed
a chance to review and comment then this permit must be denied. The citizens of
Lyons, Boulder County, and the State of Colorado have a right to ensure that their
communities and the natural environment are protected from destruction. We, the
citizens of Colorado, will not stand for a repeat of past mistakes made by agencies
and private entities.
Thank You,
Jerald M. Powell, M.S.
3
