The variance <br />request was for a section of highwall directly southeast of the existing <br />shop facilities to be left open for a future portal area for a large under- <br />ground mine. <br />_ _ Energy Fuels' request for a variance was denied. However, rather than <br />force Energy Fuels to immediately backfill the pit, OSM allowed the highwall <br />area to remain open on the basis of the following stipulation: <br />13. By December 31, 1980, the applicant shall submit an approvable <br />plan for proposed underground operations for that area located adjacent <br />to the shop facility and which are leased. If an approvable plan is <br />not submitted by December 31, 1980, backfilling of the highwall shall <br />commence by January 1, 1981 and shall be completed by January 31, 1981, <br />in accordance with map 48. <br />Based on discussions between OSM personnel and Energy Fuels personnel <br />and representatives when the stipulation was agreed upon, it is our under- <br />standing that the "approvable plan" should consist of the following: <br />1. A feasible mine plan showing location of underground entries, major or <br />barrier pillars, method of mining and ventilation. Such plan would be <br />reviewed and commented upon by the U.S. Geological Survey with respect <br />to maximum resource recovery on federal coal. <br />2.
