We wish <br />to respond to those "problems." The inspection report was received by the Cripple Creek & <br />Victor Gold Mining Company ("CC&v") on October 14, 1994. <br />Both of the "problems" have been corrected some time ago and the corrective measures reviewed <br />during subsequent inspections by your staff. The first problem, that of containing the fluid in <br />the upstream sump, was corrected by installing additional geotextile in the riser pipe. A small <br />amount of water still enters the pipe, but very little sediment is entering the underdrain. These <br />mitigation measures were discussed with a number of Office of Mined Land inspectors. Further, <br />on October 14, 1994, we submitted the plan to remove the sump as soon as it is surrounded by <br />liner and the weather permits. This plan consists of procedures to meet the applicable <br />specifications. All unsuitable silt and clay will be removed, the drain standpipe removed, the <br />liner and geotextile repaired, and the underdrain completely isolated from the overlying system. <br />As stated numerous times, CC&V will not allow the sump area to be completed until all <br />elements meet the applicable designs and specifications. <br />With respect to the second "problem," CC&V undertook to replenish the straw bales <br />immediately upon discovery of bypassing. The replenished sediment control system was <br />observed by a number of inspectors since it was observed and the mitigation measures found, <br />we believe, to be appropriate. As you know, while the area in question is within the disturbed <br />area boundary, it is not yet cleared for disturbance by the Bureau of Land Management. <br />Therefore we are limited in the amount of disturbance that is permitted. Further, the sediment <br />that has been observed is, in large part, the same sediment that occurs routinely from Arequa <br />Gulch. As is evident, the piping system that carries Arequa Gulch to the area is complete such <br />[hat construction now contributes negligible sediment to the system and, therefore, the majority <br />
