~.-,..~ -_.._~ ~r. ..... -~-,_.~....~. .._ ~ ..- .. <br />.. <br />-31- <br />In mining t.9e western pit at the Martinez Strip Mine, the operator proposes <br />to dispose of the initial cut overburden/interburden material within the <br />backfilled area of the Eastern pit. Insufficient storage area exists <br />within the western pit area to accomrtrodate t5e spoil generated during the <br />initial cut. This material, approximately 414,000 bank cubic yards of <br />overburden/interburden, will be transported and stored within the eastern <br />pit area. Upon completion of extraction within the eastern pit, the spoil <br />wi_'1 then be finally graded in conformance with the requirements of Rule 4.14. <br />Removal of this initial spoil within the eastern pit area and the subsequent <br />smell of the remaining overburden/interburden materials will result in the <br />construction of a final post-mining topography which approximates the original <br />topographic contour [rithin the Eastern pit area. <br />The Division considers the amended post-mining topography to appropriately <br />accommodate the anticipated backfilled spoil volumes at tae Partinez Strip <br />1•Iine. However, in order to verify the accuracy of Chimney P.ock's smell <br />factor and bulking factor projections, the Division deems it appropriate <br />to impose the followiny stipulation upon approval of the permanent program <br />permit: <br />Stipulation <br />21. It is <br />the opinion of the Division that there are no special handlinu requirements <br />necessary for the placement of backfilled spoil at the M1lartinez Strip pit. <br />Given the above discussion of Chimney Rock's plan to permanentlu dispose of <br />approximately 9I 4,000 yd~ of material in the mined-or:t East pit. Reclama tion <br />will be delayed in the Southeast area of the active pit. The Division has <br />granted a delay in contemporaneous reclamation in this area to facilitate <br />completion of the proposed operation plan. <br />
