~.-,..~ -_.._~ ~r. ..... -~-,_.~....~. .._ ~ ..- .. .. -31- In mining t.9e western pit at the Martinez Strip Mine, the operator proposes to dispose of the initial cut overburden/interburden material within the backfilled area of the Eastern pit. Insufficient storage area exists within the western pit area to accomrtrodate t5e spoil generated during the initial cut. This material, approximately 414,000 bank cubic yards of overburden/interburden, will be transported and stored within the eastern pit area. Upon completion of extraction within the eastern pit, the spoil wi_'1 then be finally graded in conformance with the requirements of Rule 4.14. Removal of this initial spoil within the eastern pit area and the subsequent smell of the remaining overburden/interburden materials will result in the construction of a final post-mining topography which approximates the original topographic contour [rithin the Eastern pit area. The Division considers the amended post-mining topography to appropriately accommodate the anticipated backfilled spoil volumes at tae Partinez Strip 1•Iine. However, in order to verify the accuracy of Chimney P.ock's smell factor and bulking factor projections, the Division deems it appropriate to impose the followiny stipulation upon approval of the permanent program permit: Stipulation 21. The Division has IEVZe[Jed the geochemical overburden testing results, in order to determine whether it would be appropriate to require any special handling of toxic or acid-forming materials at the Martinez Strip. It is the opinion of the Division that there are no special handlinu requirements necessary for the placement of backfilled spoil at the M1lartinez Strip pit. Given the above discussion of Chimney Rock's plan to permanentlu dispose of approximately 9I 4,000 yd~ of material in the mined-or:t East pit. Reclama tion will be delayed in the Southeast area of the active pit. The Division has granted a delay in contemporaneous reclamation in this area to facilitate completion of the proposed operation plan.
