Land Use - Rv1es 2.04.3, 2.05. ;and 4,16 <br />The pre-mining land use at the Martinez Strip bfine is classified predominantly <br />as rangeland, cvith a small portion pastureland, as shown on Map 8, A11 areas <br />are grazed by horses, cattle and goats. <br />Chimney Rock Coal is proposing to return the disturbed areas to rangeland <br />and dryland pasture. Chimney Rock Coal is proposing to convert appro.rimately <br />20 acres of Zand from rangeland to dryland pasture to enhance the capability <br />of the Zand to suppprt livestock husbandry operations, as discussed in <br />Section 2.05,4. All applicable requirements have been addressed with the <br />exception of management practices. Therefore, the follocaing stipulation is <br />required: <br />Stipulation <br />1, A REVISED E.KHIBIT 27, DESCRIBING THE hLv NRCEdfENT PLAPIS TO BE IPfPLEt•fE:r TED <br />FOR A DRIZAND PASTURE MUST BE SUBMITTED FOR DIVISION APPROVAL WITHIN 90 <br />DAYS OF PERMIT ISSUANCE. <br />Provided the above stipulation is satisfied, the Division approves the post- <br />mining Iand use as proposed by Chimney Rock Coal. Tl:e operation is in compliance <br />with the requirements of Rule ?.07.6(2)(1). <br />The application is in compliance with the requirements of this section. <br />III. Cultural and listoric Resources - Rules 2,04.4 and 2.05.6(4) <br />The applicant has submitted a site-specific Iiteratvre search of the proposed <br />permit area. The literature search was performed by the Colorado State Historic <br />Preservation Officer. Based on this report, other information contained in the <br />application, and cormnerts received from the Colorado Historical Society, the <br />Division finds that the proposed mining operation will not adversely affect <br />any publicly owned park or place listed on the National Register of Historic <br />Places (2.06.5(2)(e)). <br />The proposed operation is in compliance. <br />IV. Geology - Rules 2.04.5 and 2.04.6 <br />The pznposed operation lies on the northern rim of the San Juan Basin in south- <br />western Colorado. The San Juan Basin is an asymmetric structural basin containing <br />sedimentary rccks ranging from Cambrian to Holocene in age. <br />Mining operations will extract the A, B, and C coal seams, :yhich are located <br />in the Fruitlandrormation. The coal seams dip F to 8 to the southwest <br />and strike :160°W. No fault exists in the permit area. <br />
