SUMMARY <br />The Review Process <br />The Apex No. 2 Mine, operated by Sunland Mining Corporation, is located in Routt <br />County approximately 6.5 miles northwest of the town of Oak Creek along Routt County <br />Road 29. The mine has been operated by Sunland Mining Corp. since 1976. <br />The original permanent program permit application was submitted by Sunland Mining <br />Corp. on February 4, 1981. The Division proposed to approve this application as <br />detailed in the proposed decision and findings of compliance document dated March, <br />1983. This decision to approve became final and Permit C-81-011 was issued to Sunland <br />Mining Corp. on May 26, 1983 for afive-year term. <br />The Apex No. 2 Mine temporarily ceased operations January 26, 1986. On May 16, 1988 <br />the Division issued a proposed decision to approve the renewal of the original permit <br />(permit renewal No. 1) and this became final after the 30 day public comment period <br />without cotttment. <br />As required by Rule 2.08.5(2)(a), the Division sent notice to Sunland Mining Corp. on <br />August 3, 1992 pertaining to the forthcoming expiration of Permit C-81-011 on May 26, <br />1993 and the right of successive renewal. Sunland Mining Corp. submitted Permit <br />Renewal No. 2 application which was received by the Division on November 30, 1992 <br />(prior to the 180-day filing date). This application was deemed complete on December <br />10, 1992. The Division forwarded adequacy letters to Sunland Mining Corp. on February <br />8, 1992.
