The narrative regazding Reclamation Schedule and Costs on page 3-20, will need <br />updated to be consistent with revegetation plan and cost estimate information <br />amendments. <br />13. Statements on page 4-17 and 4-20 regazding, respecfively, groundwater and surface water <br />monitoring, indicate that the annual hydrology report will be submitted immediately <br />after data collecting and analysis . We request that the statement be clarified by <br />indicating that "the report for the previous water year will be submitted no later <br />than February 1 of each yeah, to be consistent with Stipulation No. 26. <br />Section VI -Bonding Summary <br />The Division approved a bond adjustment revision (SI-1) on June 29, 2001. The bond adjustment was <br />based on a reclamation cost estimate performed by the Division associated with review of the RN-OS <br />pemut renewal application. The reclamation liability amount prior to SI-1 was $192,537.00, and the <br />Division held a cash bond in that amount. The adjusted liability amount estimated by the Division, and <br />set forth in SI-1, was $271,563.00. The updated liability estimate included revised equipment costs, <br />and new or amended costs for various reclamation tasks. LEI submitted a new cash bond (Bond No. <br /> in the amount of $79,026.00 on July 12, 2001. The Division accepted the new bond on <br />July 20, 2001. SI-1 Bond Adjustment brought the total bond amount held by the Division to <br />$271,563.00, in the form of two separate cash bonds. This amount corresponded exactly with the <br />liability amount that had been calculated for SI-1. <br />In January 2004, the Division performed an updated cost estimate in association with this midterm <br />pernut review. The detailed cost estimate (enclosed) indicates a total liability amount of $260,755.00, <br />which confirms the adequacy of the current bond amount held in the two cash bonds ($271,755.00). <br />Our review confirms that the operator has submitted a fully adequate reclamation bond that meets the <br />applicable requirements of Rule 3 (2.07.6(2)(j)). <br />C:gnc~2004 midterm <br />14 <br />
