<br /> <br />PLANNING: CONSIDER VACATION OF PORTIONS OF USRS #489 AND #636 WHICH <br />ARE OVERLAPPED BY USR #999: Todd Hodges, Department of Planning <br />Services, displayed an overhead showing how USR #999 overlaps both USR <br />#489 and #636. Mr. Hodges stated through the purchase agreement when the <br />County acquired property included in USR #999, Siegrist Construction Company <br />was required to amend its USR to vacate these portions. In response to <br />Commissioner Hall, Mr. Hodges stated currently USR #636' is owned by Varra <br />Companies, and USR #489 is owned by Siegrist Construction Company, with <br />portions of each overlapped by USR #999. Don Carroll, Department of Public <br />Works, gave a brief history of the case and reiterated item #13 in the original <br />agreement states the seller is to amend USRS #636 and 489; however, this was <br />never completed. Mr. Carroll stated he applied with the State and was <br />approved for USR #999 not knowing the old USRs were still in place. Mr. <br />Carroll referred to a letter to Carl Mount, State Division of Minerals and Geology, <br />from Mr. Siegrist, indicating that the USRS need to be corrected. In response <br />to Commissioner Hall, Mr. Hodges stated the County is not amending the USRs <br />because the property is owned by the County. In response to Mr. Barker, Mr. <br />Carroll stated Mr. Siegrist and Varra Companies were notified of the vacation <br />and voiced no objections. In response to Commissioner Kirkmeyer, Mr. Barker <br />explained the vacation does not reduce Mr. Siegrist's requirements because the <br />intent of the original agreement was for the purchased property to be taken out <br />of the USR; and a vacation meets that requirement. Mr. Hodges added he was <br />not sure if the original conditions differed from those of USR #999; however, <br />similar requirements are used for all mining pits. Mr. Carroll stated he was <br />required to do extensive prairie dog, eagle and tree studies before USR #999 <br />was acquired, and feels the conditions were more stringent than those of the <br />original Conditions of Approval and Development Standards. There was no <br />public input on this matter. Commissioner Hall moved to approve said vacation. <br />Commissioner Harbert seconded the motion, which carried unanimously. <br />RESOLUTIONS AND <br />ORDINANCES: The resolutions were presented and signed as listed on the consent agenda. <br />No Ordinances were approved. <br />;, <br />__ Let the minutes reflect that the above and foregoing actions were attested to <br />and respectfully submitted by the Acting Clerk to the Board. <br />Minutes, December 17, 1997 972623 <br />Page 4 BC0016 <br />
