<br />2.10, sufficient to describe all. proposed surface <br />disturbances to be associated with underground mining <br />activities within the permit area. <br />There exists within the permit application document and <br />various submittals including the most recent annual <br />reclamation report and the temporary cessation notice, <br />contradictory information regarding the extent of existing <br />and permitted disturbance within the permit area, including <br />the loadout. The temporary cessation notice indicates that <br />a total of 9.2 acres of surface area was disturbed for the <br />"access road and work area", but does not address loadout <br />area disturbance. Recent annual reclamation reports <br />indicate 5.6 acres of actual disturbance. The July, 1997 <br />permit renewal application form indicates 5.6 acres of <br />actual disturbance, and 122 acres of permitted disturbance. <br />Permit application text on page 2.1-1 and 2.1-2 indicates <br />2.1 acres of actual disturbance at the mine bench and 7.1 <br />acres of actual disturbance associated with the existing <br />access road, for a total of 9.2 acres of actual disturbance <br />at the mine area. On page 2.2-14, the loadout area acreage <br />(presumably all considered "disturbed") is listed as 5.57 <br />acres. <br />Please update the application text, renewal form, and the <br />various supplemental submittals as necessary to ensure that <br />the listed disturbed area acreage is accurate and <br />consistent. The amendments should reflect the fact that, <br />pursuant to Stipulation 23, existing disturbance and <br />proposed disturbance is essentially identical, with the <br />approved additional disturbance apparently limited to the <br />small area above the highwall which would be disturbed by <br />highwall elimination grading. <br />In addition, please amend appropriate mine area and loadout <br />area maps, to provide for a clearly labeled and delineated <br />disturbed area boundary, which corresponds with disturbed <br />area acreage as set forth in the application text. <br />9 <br />
