My decision to <br />approve the Powderhorn Coal Company's permit is based on: (1) <br />the applicant's complete permit application, (2) our permit <br />conditions, (3) public participation, (4) review of the <br />application by the Office of Surface Mining (OSM) and the State <br />of Colorado as required by the approved Colorado State Program, <br />and (5) compliance with the National Environmental Policy Act <br />(NEPA). The OSM permit incorporates the State's permit. <br />The Secretary may approve a mining plan for Federal lands under <br />30 L.S.C. 207(c) and 1273(c). The proposed operation is in <br />compliance with all applicable laws sad regulations. <br />I find that the proposed operations will be in compliance with <br />all applicable laws and regulations, and I recommend the <br />Roadside and Cameo Mines mining and reclamation plan updated to <br />October 4, 198 be approved. <br />I approve this mining and reclamation plan: <br />Assistant Secretary for Energy and Minerals <br />Date <br />
