<br />A chronology of events related co this MRP application is <br />enclosed. The MSnerals Management Services provided <br />vd tten concurrence vith the proposed action on September <br />29, 1982. The Bureau of Laad Management provided vrittea <br />=oncurrence on August 25, 1982. The BLH letter raised <br />several concerns that vere stipulated (see Attachment B, <br />Federal Special Stipulations). The U.S. Fish and Wildlife <br />vas consulted regarding threatened and endangered species <br />and concurred on March 25, 1982. The MMS provided written <br />concurrence in a letter to OSM dated September 29, 1982. <br />The State Historic Preservation Officer (SHPO) provided <br />written concurrence with OSM's finding of compliance with <br />36 CFR Part 800 on Hay 6, 1982. The State regulatory <br />authority will issue a permit with stipulations <br />concurrently with the Federal permit. <br />The concerns raised by BLM in their letter vere <br />stipulated. The language was combined in the first two <br />concerns and the cultural resource concerns vere carefully <br />revieved by our staff archaeologist, Mr. Foster Rirby, and <br />somewhat rewritten to satisfy both OSH and BL"I concerns. <br />The other concerns vere handled by stipulations essentially <br />verbatem. <br />The State TA reads that the bond will be payable only to <br />the State of Colorado. Bryan Munaen of CMI1tD vas notified <br />of this and he said it is a typographical error and that <br />the company realizes the bond is to be made payable to both <br />the State and the Federal Government. There are two <br />outstanding Notice of Violation (NOV) issued t7ovember 10, <br />1982 by CMLRD. Jim Herron, reclamation sepcialist, CMLRD <br />feels there will be no problems involved with mitigating <br />these NOV's (see the Findings). <br />On October 6, 1982, the Cooperative Agreement between the <br />Department of the Interior sad the State of Colorado for <br />the regulation of surface coal mining sad reclamation <br />operations on Federal lands became effective. The Aestern <br />Technical Center and the CHLRD have developed transition <br />procedures for implementing the acv cooperative agreement <br />on permit applications [hat were reviewed and decisions <br />prepared prior to the effective date of the cooperative <br />agreement. This permit and mine elan fall into this <br />cacegor;. Oa that basis, I have made the findings required <br />by 30 CFR 141.21 and recommend that a Federal permit be <br />issued. <br />The information in the Roadside and Cameo Mining and <br />Reclamation Plan, as yell as other information documented <br />in the recommendation package sad made available to the <br />applicant, has been revieved by CMI.RD staff is coordination <br />with the OSM Project Leader,•Bennett H. Young. <br />
