1 <br />November 10. 1993, at the hour of 3:30 n.m., or as soon <br />thereafter as counsel may be heard, in Judge Boulden's Courtroom <br />located on the third floor of the Federal Courthouse Building <br />located at 350 South Main Street, Salt Lake City, Utah. Th.e <br />Motion requests approval of a settlement of the above-captioned <br />adversary proceeding between the parties. CF&I brought this <br />action against Italimpianti alleging that certain transfers; made <br />to it constitute avoidable preferences under 11 U.S.C. § 54.7(b). <br />The parties have agreed to settle the matter with Italimpi~inti <br />making a payment of $21,500.00 and waiving all claims against the <br />Debtors' estates. Copies of the Motion and the related <br />Settlement Agreement may be obtained by request from the <br />undersigned counsel for CF&I. <br />PLEASE TAKE FURTHER NOTICE that, pursuant to Rule 5'J_3(b) <br />of the Rules of Practice of the United States Bankruptcy Court <br />for the District of Utah, objections to the Motion must be <br />submitted in writing, filed with the Bankruptcy Court, and served <br />upon the undersigned counsel on or before Tuesday, November 2, <br />1993. Absent timely filing and service of objections, the <br />hearing may be stricken and the relief sought in the Motion may <br />be granted by the Court without further notice or hearing. <br />Additionally, upon the resolution of any timely filed and served <br />objections, the hearing may be stricken and the relief sought in <br />2 <br />
