Map 3 now correctly shows all sites that have been <br />surveyed at the Deserado Mine area. A separate minor revision request letter has <br />been forwarded to the Colorado Mined Land Reclamation Division (CMLRD) asking that <br />new Map 3 replace the map currently in the permit. Seven Copies of the map are <br />being sent to OSMRE via copy of the CMLRD minor revision request. We believe Lhia <br />satisfies Special Condition No. 2. <br />Western Fuels-Utah, Inc., in conjunction with its archaeological contractor, has <br />developed a plan to mitigate potential impacts from subsidence on cultural resource <br />sites eligible for the National Register of Historic Sites. The enclosed plan is <br />specific to site 5RB859, but will be used to mitigate other eligible sites that <br />overlie areas that will subside. The mining plan has changed since its inception <br />and may change in the future. Unforeseen plan changes prohibit detailed plane for <br />other eligible sites at present. However, Chia plan will apply to other eligible <br />sites that overlie potential subsidence zones. The enclosed plan satisfies <br />Special Condition No. 3. <br />Very truly yours, <br />Tommy D.
