Simpson, Deputy State Engineer //I,~' <br />SUBJECT: Pueblo East Pit, Valco Pueblo Concrete Division, File No. M-86-015 <br />E1/2 NEl/4, Sec. 34 and SW1/4 NWl/4, Sec. 35, TLOS, R64W <br />As requested, we have reviewed the above referenced app]ication for a permit <br />to mine sand and gravel on 68 acres approximately 1 1/4 miles east of Pueblo, <br />Colorado. Aground water pond will be created by this operation. This pond <br />will be used as habitat for fish and wildlife. <br />Using an impoundment of water for recreational purposes, incluuing fishery and <br />wildlife, has been defined in Section 37-92-103, CRS (1973), as putting the <br />water to beneficial use. Since the source of water for the pond that will be <br />created by the gravel pit operation is ground water and the ground water will <br />be used beneficially, we require that a well permit be obtained from our <br />office. The well permit must be obtained prior to excavation of the gravel <br />pit. Otherwise, Valco, Inc. will be in violation of Section 37-9U-137, CRS <br />(1973). Since the proposed gravel pit would be located in an over-appro- <br />priated basin, the well permit could not be obtained until a court approved <br />plan for augmentation has been developed. <br />"Plan for augmentation means a detailed program to increase the supply of <br />water available for beneficial use in a division or portion thereof by the <br />development of new or alternate means or points of diversion, by a pooling of <br />water resources, by water exchange projects, by providing substitute supplies <br />of water, by the development of new sources of water, or by any other appro- <br />priate means..." (Section 37-92-103(9), CRS (1973)). Valco, Inc. should <br />devise an augmentation plan to replace the out-of-priority consumptive use <br />associated with pond evaporation and other out-of-priority consumptive uses of <br />water. <br />Valco, Inc. has provided insufficient information concerning the use of water <br />in the mining operation. In order for us to comment, we would need to know <br />the quantities of water to be used for dust control, washing, and other pur- <br />poses. We would also need to know the sources of water for the operation and <br />
