is <br />sss <br />APX O Page - 4 <br />McCLANE CANYON MINE <br />=~~ Road Compliance Statement <br />4.03.1 (1) General Requirements <br />The McClane Canyon access and haul road was constructed in 1977; therefore, this <br />compliance statement is being written to comply with the regulations that became <br />effective some 20 years after the road was constructed. No person involved with the <br />design, construction or permitting of the road is available to confirm the process. <br />The road has had no discernible effect upon the conditions existing in the area with <br />regard to erosion, pollution of air or water. The road has not caused damage to <br />public or private property. The road has not caused damage to fish, wildlife, and <br />related values. The road has proven to be designed adequately based upon the way <br />that the road has functioned over the years. The road will be removed and reclaimed <br />when mining has been completed. <br />(2) Location <br />Since the road was built in 1977 the location of the road is fixed. No part of the road <br />is in a stream channel, except where the channel has been crossed using Division <br />approved methods. No fords of any channels exist. <br />-~ (3) Design <br />The overall Grade of the road is 5.9 percent ,the maximum pitch is 10.7 percent <br />and the no area of the road is steeper than the requirements. The horizontal <br />alignment is fixed and is consistent with the topography. The width of the road is <br />approximately 22 feet, has been adequate for the vehicles using the road, and will <br />be adequate for anticipated future vehicles. The road cuts have been stable for the <br />life of the road. The only stability problems encountered have been from natural <br />slopes sliding onto the haul road. Erosion along the road is controlled by the <br />revegetation that has occurred. <br />Road embankments have also been stable for the life of the road. It is unknown if <br />vegetation was removed, which specific materials were utilized to construct the <br />embankments, or how the material was placed. No topsoil was salvaged from the <br />alignment. <br />(4) Drainage <br />The drainage structures along the road have functioned v~ill during the last 20 years. <br />The road has not washed out. The drainage structures along the road have a <br />demonstrated ability to safely pass the runoff from storms up to the 50 year 24 hour <br />storm event. The McClane Creek was diverted to the north from its natural location. <br />The relocation was done in 1977 and was apparently approved by the regulating <br />agencies prior to diversion. Grand Valley Coal has committed to study the adequacy <br />of the design.
