Specifically, the surface of Lots 2, 4 and <br />5 of Section 11 of Preference Right Lease Application (PRLA) <br />C-0126669 are at present controlled by BLM. Western Fuels <br />owns PRLA C-0126669 and anticipates the lease being issued <br />in the near future (see attached letter). Technically, this <br />means that some surface within our permit boundary is not <br />under Western Fuels-Utah's control. <br />JOHN E. RANDALL Practically, this oversight does not impact the mining <br />Winnsboro, Louisiana plan contained in the permit. We will not enter on the <br />R. E. TEARNEY surface of Lots 2, 4 and 5, or create any disturbance on <br />Kansas Cily, Kansas these lots. Our five year mining plan also shows that we <br />E. R.INMAN will not mine coal from this area. The utility corridor <br />Sikeston, Missouri is west of the boundary of these lots. <br />ARTHUR J. SCHNOSE <br />Hays. Kansas Since Western Fuels will control the surface of these lots <br />LEWIS E. MITCHELL in the near future, by securing the coal lease, we suggest <br />Scoll City, Kansas that we take no action. Within a short time this oversight <br /> will have been rectified. However, we felt we should inform <br />GENERAL MANAGER your office in the event you think we should change the <br /> permit boundary to exclude these lots.
