Proposed Decision <br />The Colorado Division of Minerals and Geology proposes to approve, with stipulations, an <br />application for renewal of a valid existing permit. <br />The application was submitted by Colorado Yampa Coal Company for Mine No. 3. This <br />decision is based on a finding that the operations will comply with all requirements of the <br />Colorado State Program as found in the Colorado Surface Coal Mining Reclamation Act, <br />C.R.S. 34-33-101 et seq., and the Regulations promulgated pursuant to the Act. If no request <br />for a formal heazing is made within thirty (30) days of the first publication of the issuance of <br />this proposed decision, then this decision becomes final. A valid and viable reclamation bond <br />is held by the Division at this time in the amount of $200,000.00. The permit application, all <br />supporting documentation and any stipulations or conditions will become a binding part of the <br />permit. <br />Stipulation Nos. 1 through 19 for Mine No. 3 permit have been resolved. The following <br />stipulations aze hereby attached to the Mine No. 3 permit renewal approval: <br />Stinulation No. 20: <br />THE PERMIT RENEWAL APPROVAL OF MINE NO. 3 IS CONDITIONED UPON RESOLUTION OF <br />THE PITTSTON INJUNCTION ASSOCIATED WITH FEDERAL AUDIT VIOLATIONS <br />VA 940103193 AND WV 9401 21 1 1 0, CMIS VIOLATION C83-013-106-002 AND FOUR (4) <br />AML FINES FOR PERMIT VA 4405 5 860 1 A. PROOF OF RESOLUTION OF THIS ISSUE MUST <br />BE SUBMITTED TO THE DIVISION AS SOON AS IT BECOMES AVAILABLE. <br />Stipulation No. 21: <br />THE OPERATOR MUST SUBMIT A COMPLETE MINOR REVISION BY AUGUST 25, 1995 WHICH <br />PROVIDES AN UPDATED AND ACCURATE DRAINAGE AND SEDIMENT CONTROL MAP 4A. <br />THIS MAP SHOULD ACCURATELY REPRESENT THE CURRENTLY APPROVED DRAINAGE <br />CONTROL PLAN AND FEATURES AS THEY EXIST ON THE GROUND. <br />2 <br />
