Stipulation No. 3 required Eastside to provide a plan for locating the <br />60-percent sediment level in both sediment ponds. The plans are shown on <br />Drawing 3 (SP-1) and Drawing 4 (SP-2). This stipulation also requires <br />maintenance of sediment accumulation below this level, which has been <br />performed by the operator. Therefore, Stipulation 3 is modified, and remains <br />in effect. <br />Stipulation No. 3 <br />SEDIMENT PONDS SP-1 AND SP-2 WILL BE MAINTAINED WITH SEDIMENT AT OR <br />BELOW THE 60 PERCENT LEVEL. <br />The Division's review of Annual Hydrologic Reports submitted by the operator <br />indicates little or no surface water impact occurring. <br />With acceptance of the above stipulations, the operation is in compliance with <br />the requirements of this section. <br />VI. Ground Water Hydrology - Rules 2.04,5, 2.04.7, 2.05.3(4), 2,05,6(3) and <br />The Eastside Mine around water monitoring program was modified by Technical <br />Revision 3, approved in April, 1988. The mine wells 0.5 and 1.5 (Stipulation <br />No. 1 in previous section) are no longer sampled, as it had become clear that <br />no off-site impacts were occurring. The permittee continues to conduct a <br />yearly mine inflow study, and to monitor mine water discharge in accordance <br />with Stipulation No. 1. <br />The refuse disposal area referred to in Stipulation No. 1 has not been <br />constructed at the time of permit renewal. <br />The operation is in compliance with the requirements of this section. <br />VII. Water Rights and Replacement - Rules 2.04,7(3) and 4.05.15 <br />Stipulation No. 4 of the Eastside permit required that the operator quantify <br />consumptive use of water at the mine, and that possible sources of <br />augmentation water be identified. At maximum production, Eastside estimates <br />that approximately 4 acre-feet of water would be consumed annually. Eastside <br />has purchased one share of the Farmers Irrigation pitch Company, which <br />entitles them to 3.6 acre-feet of 'water per year, to augment flow from Grass <br />Valley Reservoir. Stipulation No. 4 is therefore satisfied, <br />The operation is in compliance with the requirements of this section. <br />VIII. Probable Hydrologic Consequences of Mining at the Eastside Mine <br />The Probable Hydrologic Consequences section of the orioinal Eastside Mine <br />Findings Document described in detail the hydrologic and geologic environment <br />at the mine, and is hereby incorporated into this document. Due to the <br />extensive periods of inactivity, very little mine development has taken place <br />at Eastside. For the same reason, there has been little or no hydrologic <br />impact during the first permit term. <br />-7- <br />
