My <br />clients' property is comprised of some 36 acres and within sections <br />19 and 30 of township 49 north, range 9 west, NMPM and carries a <br />street address of 13221 Marine Drive, Montrose, CO. The Ganns' <br />property lies immediately adjacent to the Coreys' property for which <br />the mining permit noted above was issued in 1987. <br />Ironically, my clients purchased their property and trout farm <br />business from the Coreys in the early 1980s and have owned and <br />operated the business since that time. The Ganns' property lies <br />along a creekbed which is oriented in a north-south direcY.ion and <br />is perhaps 200 to 300 yards wide. This are: is commonly known as <br />Mexican Gulch and is located to the west and northwest of Montrose <br />on Spring Creek Mesa. The Coreys' land here of concern lies above <br />and immediately to the west cf, and is contiguous to, that of my <br />clients. <br />Critical to the Ganns' continued successful operation of their <br />trout farming business is a continuous supply of clean and cold <br />water. My clients' trout (and their business) will be unable to <br />survive if their several adjudicated springs become polluted or if <br />the water temperature should become increased in any significant <br />way. <br />While operations under the above-noted mining permit have been <br />underway for some time, as far as I am presently aware, there has <br />been no detrimental effect upon the trout farm. While I am neither <br />a geologist nor a hydrologist, I understand that at least part of <br />the reason for this fortunate circumstance is that the Corey gravel <br />pit operation lies downgrade and to the northwest of my clients' <br />•97U AREA CODE MANDATORY JANUARY f, 1996 <br />
