Section III - Status of Stipulations <br /> The five stipulations associated with the renewal of the mining and <br /> reclamation permit for the Roadside and Cameo Mines on January 3, 1988 are <br /> listed below. The numbers of the stipulations are not consecutive; certain <br /> stipulations derive from those that accompanied the original permit and are <br /> ongoing in nature; others have been added as revisions to the original permit <br /> were approved; those that have been satisfied prior to the current review have <br /> been omitted from the list. The status of each was determined as part of this <br /> review and is included in the listing. <br /> STIPULATION NO. 1 : <br /> SIX MONTHS PRIOR TO BACKFILLING THE CAMEO AND NORTH DECLINES, THE <br /> PERMITTEE MUST SUBMIT A PLAN FOR DISPOSAL OF COAL PROCESSING WASTE IN <br /> THE CAMEO AND NORTH DECLINES TO THE DIVISION FOR APPROVAL. THIS PLAN <br /> MUST INCLUDE A DISCUSSION OF THE PROJECTED EFFECTS OF DISPOSAL AND A <br /> RECLAMATION PLAN FOR THE DECLINES. <br /> As previously noted, this stipulation will not require resolution until the <br /> mine nears permanent cessation of operations. It is ongoing in nature and <br /> will be attached to the current permit. <br /> STIPULATION NO. 2: <br /> THE PERMITTEE SHALL SUBMIT TO THE DIVISION AN ANNUAL REPORT OF INFLOWS, <br /> DISCHARGES AND CONSUMPTION OF WATER WITHIN THE MINE. THIS REPORT IS TO <br /> INCLUDE A MINE WORKINGS MAP SHOWING THE LOCATION AND QUANTITY OF <br /> INFLOWS; A TABLE KEYED TO THE MINE MAP WHICH SHALL CONTAIN THE SOURCE <br /> (I.E. , FAULTS, FRACTURES, ETC. ), QUANTITY , DURATION, AND QUALITY <br /> (pH, ELECTRICAL CONDUCTIVITY , AND TEMPERATURE) OF ALL INFLOWS; A TABLE <br /> CONTAINING RECORDS OF WATER DISCHARGED FROM THE MINE, CONSUMED IN THE <br /> MINE AND IMPORTED FOR USE WITHIN THE MINE; AND A DISCUSSION OF THE <br /> WATER BALANCE IN THE MINE. <br /> This stipulation is ongoing in nature and thus remains attached to the <br /> permit. The mine has complied with this stipulation for all monitoring years <br /> since the renewal of the permit. <br /> STIPULATION NO. 6: <br /> IF THE FIELD TRAILS CURRENTLY BEING CONDUCTED AT THE ROADSIDE COAL <br /> PROCESSING WASTE EMBANKMENT DEMONSTRATE THAT REVEGETATION SUCCESS <br /> CRITERIA CANNOT BE MET BY LESS THAN FOUR FEET OF NON-TOXIC, <br /> NON-COMBUSTIBLE COVER AND/OR THAT DISTURBANCE TO THE HYDROLOGIC BALANCE <br /> IS NOT 14INIMIZED WITH LESS THAN FOUR FEET OF COVER, THE PERMITTEE WILL <br /> BE REQUIRED TO PLACE FOUR FEET OF THE BEST AVAILABLE NON-TOXIC, <br /> NON-COMBUSTIBLE COVER OVER THE ROADSIDE REFUSE PILE AND CAMEO NOS. 1 , <br /> 2, AND 3 REFUSE PILES. <br /> This is an ongoing stipulation attached to the current permit. The field <br /> trials are still in progress. No formal approval by the Division of the use <br /> of less than four feet of cover at any of the various refuse areas has been <br /> made at the time of this review. <br /> -4- <br />
