<br />Attachment 1 <br />Notification Requirements Imposed by the 1984 RCRA Amendments <br />Under the 1984 RCRA Amendments, tank owners .and distributors of petroleum <br />products must comply with the following requirements: <br />• For Tank Owners. By May 6, 1986, owners of underground storage tanks must <br />noti y tie esig ed state agency of the existence, size, type, location and <br />use of each tank; both operational and non-operational, using the appropriate <br />notification form. <br />• For Distributors. Be innin December 8 1985, and for 18 months <br />therea ter, ism utors o Petro eum pro ucts must notify their customer tank <br />owner/operators u. their obligatid~r t~ notify the designated state agency. <br />• For New Tanks. For tanks installed after May 8, 1986, owners must notify <br />the esignate sate agency within 30 days of bringing the tank into use. <br />Definitions: <br />Tank Owner is defined as 'any person wh <br />used or the storage, use or dispensing of <br />petroleum products). Therefore, <br />it is possible for an above ground tank that is partially buried to be subject <br />to the notification requirements. <br />Exemptions_ <br />Exempted from the notification requirements are owners of nonoperational <br />tanks (i.e., in use before but not after November 8, 1984), that have been <br />removed from the ground, and owners of tanks who have already provided notice <br />to EPA under Superfund requirements. Also exempted by virtue of the statute's <br />definition of underground storage tanks are owners of (1) farm and residential <br />tanks of 1,100 gallons or less used to store motor fuel for noncommercial <br />purposes; {2) tanks used for storing heating oil for consumptive use on the <br />premises where stored; and (3) flow through process tanks. <br />Penalties <br />Penalties of up to ;10,000 for each tank can be imposed for failure to <br />notify, or for knowingly submitting false information. <br />
