Long <br />Drvrsion Duectar <br />On August 30, 1993, we received a copy of your office's August 27, 1993 letter <br />sent to Mr. Jim Tatum requesting a copy of the March 8, 1993 report prepared <br />by Colorado Real Estate Inspection Services, Inc. for Mr. Tatum. <br />In this letter to Mr. Tatum, you stated "I requested a copy of the report <br />prepared for you by Colorado Real Estate Inspection Service of Denver from <br />Mr. Daniel I. Hernandez, Senior Reclamation Specialist of the <br />Division of Minerals and Geology. He was either unable or unwilling to <br />give me a copy of that report." ~- <br />Please understand that our recommendation to your office that it obtain a copy <br />of this report from Mr. Tatum directly was not an effort on our office's part <br />to be uncooperative with requests from your office for information about the <br />Golden Eagle Mine. We understand that Mr. Tatum is currently involved in <br />litigation with Basin Resources, Inc. As such, when Mr. Tatum provides our <br />offices with information that states "For the Exclusive Use of Mr. Jim Tatum," <br />and our office has not received specific approval from Mr. Tatum to make that <br />information widely available, we must exercise caution with its use. <br />Please also understand that copyright matters are also a consideration <br />for us when proprietary data is submitted to our offices. As <br />Colorado Real Estate Inspection Services, Inc. provides its reports to clients <br />for a fee, photocopying of their proprietary materials without their approval <br />can place the Division in precarious legal position as well, especially when <br />that service is requested by a client as part of litigative proceedings. <br />~t<,b lip /'or ~~sJov~ ccr~..r ti <br />STATE OF COLORADO <br />
