No. 95-164, Title I, ; 101, 91 Stat. 1290 (Nov. 9, 1!i77) <br />and amended 1972, 1977, 1981, 1985, and 1987) (the "1969 ]1ct'') <br />establishes a comprehensive program for providing benefits, <br />including disability, medical, and survivors' benefits <br />(collectively "Slack Lung Benefits") to coal miners who are <br />totally disabled due to pneumoconiosis (aka black lung disease) <br />and to certain surviving dependents of coal miners who die due to <br />pneumoconiosis. Part C, Title IV, of the 1969 Act, 30 U.S.C. <br />3§ 931-45, assigned the responsibility for payment of allowed <br />black lung claims filed on or after January 1, 1974 to state <br />workers' compensation programs approved by the Secretary of Labor <br />(the "Secretary"). Where there vas no approved state worke:cs' <br />compensation law in place after December 21, 1972, Dlack Lung <br />Benefits would be paid directly to claimants by responsible <br />underground coat mine operators identified by the Secretary or, <br />in those instances where a responsible coal mine operator could <br />not be identified, by the Secretary from federal funds. <br />30 U.S.C. 55 932(b).
