Pursuant to Rule 2.08.6(4) of the Regulations of the Colorado Mined Land Reclamation
Board for Coal Mining ( ules) promulgated pursuant to the Colorado Surface Coal Mining
Reclamation Act (Act) 34-33-101 et seg. C.R.S. 1973, as amended, the Division makes the
following three written findings riot to the approval of the transfer of Rights under the
permit for the King Coal Mine Permit C-81-035):
The Division finds that National King Coal, LLC, upon compliance with Stipulation
10 on the Kingg Coal Mine permit, will be eligible to receive a permit in accordance
with Rule 2.07.6(1)(b), (c), and (2).
The condition upon the Division's approval is:

THE PERMIT TRANSFER FROM NATIONAL KING COAL COMPANY, INC. TO
NATIONAL KING COAL, LLC IS CONDn70NED UPON RESOLUTION OF THE
WFSr VIRGIMA SETTLEMENT AGREEMENT ASSOCIATED WTIN 16
VIOLATIONS UNDER PERMIT WV-SO04084. PROOF OP RESOLIIIION OF
THESE ISSUES MUST BE SUBMPI-IED TO TI1E DMSION AS SOON AS IT
BECOMES AVAILABLE.
2. The Division finds the applicant, National King Coal, LLC, has submitted a
performance bond at least equivalent to the bond of the original permittee.
3. The Division finds the applicant, National King Coal, LLC, has committed to conduct
the operations involved in full compliance with the terms and conditions of the
original permit and in accordance with the requirements of the Act and these Rules.
