C.R.S. 1973, as amended, the Division makes the <br />following three written findings riot to the approval of the transfer of Rights under the <br />permit for the King Coal Mine Permit C-81-035): <br />The Division finds that National King Coal, LLC, upon compliance with Stipulation <br />10 on the Kingg Coal Mine permit, will be eligible to receive a permit in accordance <br />with Rule 2.07.6(1)(b), (c), and (2). <br />The condition upon the Division's approval is: <br />Stipulation 10 <br />THE PERMIT TRANSFER FROM NATIONAL KING COAL COMPANY, INC. TO <br />NATIONAL KING COAL, LLC IS CONDn70NED UPON RESOLUTION OF THE <br />WFSr VIRGIMA SETTLEMENT AGREEMENT ASSOCIATED WTIN 16 <br />VIOLATIONS UNDER PERMIT WV-SO04084. PROOF OP RESOLIIIION OF <br />THESE ISSUES MUST BE SUBMPI-IED TO TI1E DMSION AS SOON AS IT <br />BECOMES AVAILABLE. <br />2. The Division finds the applicant, National King Coal, LLC, has submitted a <br />performance bond at least equivalent to the bond of the original permittee. <br />3. The Division finds the applicant, National King Coal, LLC, has committed to conduct <br />the operations involved in full compliance with the terms and conditions of the <br />original permit and in accordance with the requirements of the Act and these Rules. <br />
