Proposed Decision <br />r <br />I' <br />v~' ~~ ,=~ <br />~~•• <br />The Colorado Division of Minerals and Geology proposes to approve with stipulations the <br />application for Permit Revision 2 to conduct surface coal mining operations at the Seneca II-W <br />Mine. <br />The application was submitted by Seneca Coal Company. This decision is based on a finding that <br />the operations will comply with all requirements of the Colorado State Program as found in the <br />Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and the Regulations <br />promulgated pursuant to the Act. If no request for a formal heazing is made within thirty (30) <br />days of the fast publication of the issuance of this proposed decision, then this decision becomes <br />fmal. Upon submittal of acceptable surety by the applicant, the permit will be issued. The permit <br />application, all supporting documentation and any stipulations or conditions will become a binding <br />part of the permit. <br />Stipulation attached to Minor Revision 42- July 29, 1997 Continues in effect: <br />Stipulation 24: Proof of resolution of Kentucky Civil Penalty Violation and bond forfeiture <br />associated with Permit Number 8980140 shall be submitted to DMG as <br />soon as it becomes available. <br />Summary of Resolved Stipulations Since last Findings Document -February 23, 1996 <br />Stipulation 23: Stipulation 23 was attached to the Proposed Permit Renewal Decision dated <br />February 23, 1996. SCC was required to justify the woody plant density <br />standazd. Technical Revision 26 was submitted and approved on June 21, <br />1996 to comply with this stipulation. <br />Stipulation 25: Stipulation 25 required SCC to reevaluate designs for sediment pond <br />006. TR-29 was submitted and approved on December 8, 1997 to comply <br />with this stipulation. <br />Stipulation 26: Stipulation 26 required SCC to revise the backfilling and grading schedule <br />for 006 Gulch and the North Block Area. TR-28 was submitted and <br />approved on December 5, 1997 to comply with this stipulation. <br />Stipulation 27: Stipulation 27 was attached to TR-29 requiring SCC to survey the sediment <br />level in Pond 006 and to provide a pond cleanout plan, if necessary. SCC <br />submitted the required information on May 26, 1998. This stipulation has <br />been complied with. <br />Seneca II-W Findings Document 3 November 3, 1999 <br />
