Nucla, C-E1-008; Seneca II, <br />C-80-005; Seneca II-6', C-62-057 <br />Dear Mr. Lunan: <br />A recent inspection at the Seneca II-6' Mine revealed that Peabody presently <br />has one million dollars of personal injury and properly damage insurance to <br />cover all operations in the State of Colorado. Rule 2.03.9 requires that <br />"Minimum insurance coverage... shall be 5300,000 for each occurrence and <br />5500,000 aggregate. This rule has been interpreted by the Division to mean <br />that each permit must have this coverage. Since Peabody wishes to cover all <br />three permitted mining operations with one insurance policy, total coverage <br />must be one and one-half million dollars.
