A. Letters of citizen complaints were received by CMLRD on
November 16 and 21, 1988. These letters complained of excessive noise,
shock waves, damage from blasting and dust. Dates and times of the
blasts in question were as follows:
October 03, 1988, 2:47 (P.M.) shock waves
October 04, 1988 6:15 (P.M.) dust and blast
October 13, 1988 11:05 (A.M.)
October 19, 1988 2:25 (P.M.) dust and shock waves
October 28, 1988 2:50 (P.M.) shock waves and noise
October 31, 1988 2:10 (P.M.) huge blast noise and shock waves
November 7, 1988 3:45 (P.M.) huge blast
Further, a telephone call was received on December 2, 1988 which
documented dates, times and effects of blasts. The caller claimed that
effects from the blasts could have caused some raveling of the dirt wall
foundations of the house.
B. Based upon these complaints, an inspection was conducted at the Nucla
Mine on December 7, 1988. This inspection was conducted by Carl B. Mount
with J.M. Clapton and Matthew S. Hayes. During this inspection the
blasting records were inspected. Blasts on October 20, October 28,
November 17 and December Ol, 1988 were discovered to be out of compliance
with Section 120 (2)(o)(III) of the Colorado Surface Coal Mining
Reclamation Act, Rule 4.08.4 (10)(b)(i) and (ii) and the commitment in
Table 12, page 12-34 of Peabody's approved blasting plan.
NOV C-88-049 was issued at 4:20 P. M. on December 7, 1988. This Notice of
Violation specified that Peabody Coal immediately comply with their
approved blasting plan and submit future blasting records to the Denver
office of CMLRD until further notice.
