Pursuant to the approved application for Amendment Number 6 to the subject permit and Cripple
Creek & Victor Gold Mining Company's ("CC&V") commitment number " 36" thereto, the
following description and attachments constitute CC&V's response. The material supports use
of the Pikes Peak Granite material to be removed from the footprint area of the Valley Leach
Facility, as well as the use as originally planned of the granitic development rock material placed
below the former site of Economic Mill complex, as the underdrain rock. The commitment
reads as follows:
"All underdrain fill materials 1vi11 be comprised of durable, non-slaking, and
chemically inert rock material, and must meet the gradation defined in the
tecltnica[ specifications in this Application. /f any underdrain fill materials or soil
liner materials that have been placed are shown [o be acid or toxin generators by
the geochetnical evaluations acceptable to the O-(jtce, and such materials were
placed prior to receipt of OMLR approval, materials not meeting the criteria will
be completely removed, properly disposed of, and replaced with acceptable fill.
The technical specifications included in this Application (Volumes V and Vl,
Appendix E; February 28, 1994) are understood by CC&V to constitute
enforceable permit parameters. "
