Long <br />Division Dvecmr <br />The Division felt that it would benefit all parties to review commitments <br />made during the October 14, 1993 meeting between the Division, Phil <br />Kessler and Dr. Corley regarding removal and replacement of the Corley <br />water line and the EFCI waterline. Dr. Corley stated on October 14, 1993 <br />that his line was damaged as a result of the current reclamation work in <br />the Duck Pond Pit. The Division noted no evidence of a break in the line <br />nor did Phil Kessler. Kessler has yet to clean out the coal waste <br />located near the water line when Dr. Corley stated there was a leak, nor <br />was he disturbing the area in any way. <br />Dr. Corley stated, to the Division and' Phil Kessler, to go ahead and <br />remove the water line in order to remove all of the coal waste from the <br />drainage. Kessler stated that he would build the trench, and Dr. Corley <br />would replace the pipe and the cost for re-attaching the water line. <br />EFCI also agreed to allow Kessler to remove a portion of their water line <br />to complete the removal of coal waste in the drainage. EFCI agreed to <br />supply the pipe and part of the labor involved to re-attach the water <br />line. Kessler stated that he would build the trench as done for Dr. <br />Corley. <br />As stated in the General Bid Specifications, the Contractor is <br />responsible for damage to utilities and DMG is not responsible for the <br />agreements stated above. <br />Sint rely, <br />~~ s-~ <br />Erica S.
