Proposed Decision <br />The Colorado Division of Minerals and Geology proposes to approve an application for renewal <br />of the valid, existing permit C-1981-025 (Permit). The application was submitted by MINREC, <br />Inc. for the North Thompson Creek Mines. This decision is based on a fmding that the operations <br />will comply with all requirements of the Colorado State Program as found in the Colorado <br />Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and the Regulations <br />promulgated pursuant to the Act (Rules). If no request for a formal hearing is made within thirty <br />(30) days of the first publication of the issuance of this proposed decision, then this decision <br />becomes fmal. The permit application, all supporting documentation and any stipulations or <br />conditions will become a binding part of the permit. <br />Summary <br />History of the Review Process <br />On August 15, 1983, the North Thompson Creek Mines were issued a permanent program <br />permit, Permit No. C-81-025, for afive-yeaz term, The Division renewed this Permit for <br />subsequent five-yeaz terms on August 16, 1988, August 15, 1993, and August 15, 1998. The <br />current five-year-term Permit expires on August 15, 2003. This renewal will expire August 15, <br />2008. The mine is no longer producing coal, and nearly all of the reclamation work was <br />completed by 1987. <br />On October 4, 2002, the Division notified MIIVREC that a permit renewal application for a <br />fourth term must be submitted 180 days preceding expiration of the pemut. MINREC, Inc. <br />submitted (dated February 3, 2003) an application for the renewal of the North Thompson Creek <br />Mines Permit C-1981-025 (Application). The Application was received at the Division on <br />February 5, 2003. The Division found the application complete on February 12, 2003. The <br />applicant had published a public notice of the application for permit renewal in the Glenwood <br />Springs Post Independent once each week for four weeks (Mazch 3, 10, 17, and 24, 2003). The <br />Division received no comments concerning this renewal. <br />A preliminary adequacy review letter, in which the Division identified deficiencies in the original <br />renewal Application, was sent to the Applicant on April 10, 2003. Resolution of the deficiencies <br />was required in order for the Division to make determinations of compliance with the Act. The <br />Applicant responded to the comments on April 18, 2003, with the submittal of revised pages to <br />the Application. The Division fmds that the permit maybe renewed. <br />Previous analyses of the North Thompson Creek mining and reclamation operation have included <br />the original permitting review, mid-term and permit renewal reviews, and minor and technical <br />revision reviews, and reviews of inspections and reports.
