11. The Division has made a positive determination that there is no prime farmland within the <br />permit azea. Based on information provided in the application, the Division has determined that <br />an alluvial valley floor exists within the permit or adjacent azea. This alluvial valley floor is <br />known as the Roazing Fork Valley and was affected by the loadout. The essential hydrologic <br />functions of this alluvial valley floor were restored by reclamation work [Rule 2.07.6(2)(k) and <br />2.06.8(3)(c)]. For additional findings concerning this alluvial valley floor, please see Section B, <br />VIII, below. <br />12. The Division approved the post-mining land uses of the operation. It was determined that the <br />requirements of Rule 4.16 [Rule 2.07.6(2)(1)] aze met for unimproved rangeland azeas and <br />developed water resources of the mine site, and for pastureland and rangeland at the loadout site. <br />13. The Division fmds the Application in compliance with the specific approvals required under <br />Rule 4 [Rule 2.07.6(2)(m)]. See Section B of this Findings. <br />14. The Division fmds that the activities proposed by the applicant would not affect the <br />continued existence of endangered or threatened species or result in the destruction or adverse <br />modification of their critical habitats [Rule 2.07.6(2)(n)]. There was no response to coordination <br />initiated with the U.S. Fish and Wildlife Service (FWS) on this renewal of an existing pemut. <br />15. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As of <br />this date, MINREC, Inc., the operator, is current in the payment of reclamation fees required by <br />30 CFR Chapter VII, subchapter R [Rule 2.07.6(2)(0)]. <br />SECTION B <br />Rule 4 requires the following fmdings and specific approvals: <br />I. Roads -Rule 4.03 <br />All roads have been reclaimed except for those approved for permanent retention in support of <br />approved postmining land uses. Respective land owners requested all such retentions, in writing. <br />A) The Division approved the retention of the haul road depicted on Map No. D-2-3 (loadout <br />azea) of the PAP [Rule 4.03.1(1)(f)]. <br />B) The Division approved the retention of the access road depicted on Map No. D-3-2 (North <br />Thompson Creek Mines Land Use Map) of the PAP [Rule 4.03.1(1)(f)]. <br />C) The Division approved the retention of the Stoney Ridge Fan Shaft Road depicted on <br />Drawing D-3-1 of the PAP, including the bridge over North Thompson Creek, as a trail [Rule <br />4.03.3(7)(a)]. <br />13 <br />
