<br />Q• <br />R. <br />S. <br />NOTICE OF VIOLATION 2/16/84 NOV BC-84-14 <br />Act Section(s) 34-33-120(2)(e) <br />Regulation Section(s) 4.06.1 and 4.06.4(2)(b) <br />Failure to protect topsoil and failure to follow approved mine plan. <br />Specifically a portion of the southern half of the east pit which <br />has been topsoiled and seeded during the fall of 1983, subsequently <br />had spoil material placed over it which compacted and contaminated <br />the topsoil. <br />An abatement plan was submitted to the Division on 3/2/84. <br />Assessment conference was held on April 3, 1984 and a civil penalty <br />of $1,100.00 was assessed. NOV terminated 5/30/84. <br />NOTICE OF VIOLATION 2/16/84 NOV 11 C-84-21 <br />Act Section(s) 120(2)(e) <br />Regulation Section(s) 4.06.3(2)(b) <br />Moving a soil stockpile without Division approval. <br />Specifically the stabilized and revegetated stockpile west of <br />Sediment Pond No. 002 was moved to a location on top of the graded <br />fill in the east pit area. <br />An abatement plan was submitted to the Division on 3/16/84. <br />An informal hearing was conducted on the site on 4/3/84. <br />A final penalty of $2,175 was assessed. The NOV has been <br />terminated. <br />NOTICE OF VIOLATION 2/16/84 NOV IlC-84-022 <br />Permit Section(s) Sec. 2,05 of Permit Revision No. I <br />Failure to follow approved mine plan. Specifically fill material <br />was placed to a depth of about 9 feet in an area of approximately <br />340 by 150 feet by 350 feet by 180 feet. The filled area was located <br />adjacent to and west of Sediment Pond No. 002 in an alluvial valley <br />floor. <br />An abatement plan was submitted to the Division on 3/16/84. <br />An informal hearing was held on the site on 4/3/84. <br />A final penalty of 52,912.50 was assessed.
