August 29, 1998
Page 3
consequences of subsidence at active mines should be documented to contribute to
advancement of the state-of-the-art." With that said, why did OSM and DMG fail and
refuse to accurately apply the SDPS program to the data relevant to the "Tatum
complaint°7
Your closing paragraph does deserve a comment. Did you really commit to
writing, "ALL OSM EMPLOYEES ARE FULLY SUPPORTIVE OF THE
DEPARTMENT'S TRUST RESPONSIBILITIES TO NATIVE AMERICANS"7 I
know that you will see that statement quoted in the Reporter. I stand behind my
statement that OSM misleads, misrepresents, abuses, and contributes to the destruction of
citizens' properties by the coal industry. The statement is not unfounded. The only error
I committed was the omission of the Colorado Division of Minerals and Geology in my
prior statement. To make disparaging remarks of another that party must have acted in a
degrading or wntemptuous manner. If the shoe fits... The dedication to the goals and
objectives of the Act of 1977 as demonstrated during the investigation of my complaint
by the employees of the OSM and DMG was obscured by the'v failure to review the facts
with complete objectivity without being influenced by Basin's dishonesty and deceit.
The Native Americans, whose lands are being destroyed, homes being damaged and basic
rights being denied would question your dedication in upholding the "Act". Your
"objectives" undermine the very Sber and intention of the "Act".
I am scheduling a trip to Denver before too long and look forward to discussing
these matters with you in person.
Please respond to the above inquiries and direct your response to my Houston
address.
Very truly your,
Am Tatum
Enclosures
CC: Senator Phil Gramm
Citizens Coal Council
Michael Long, D'aector Colorado Division of Minerals and Geology
.~
