I am aot requesting copies of any ezhibits <br />attached to the appeal fled by Jim and Ann Tatum, IBLA Docket Number <br />96-91, or any ezhibits fded oa behalf of OSM is response to our appeal <br />Any and all written material directed to any Department official or employee from <br />any person or entity associated with Holland and Hart, Law Firm-Denver; Basin <br />Resources, Inc.; Montana Power, any subsidiary of Montana Power; or any other <br />party, individual, business or entity, concerning, relating to, referring to, <br />discussing, or in any way dealing with the complaint filed by Ann and Jim Tatum <br />against Basin Resources, Inc., a Division of Montana Power; the State of <br />Colorado Department of Natural Resowces, Division of Minerals and Geology; <br />and/or the Office of Surface Mining. I am not requesting copies of any ezhibits <br />attached to the appeal filed by Jim aad Ann Tatum,lBLA Docket Number <br />96-91, or any ezhibits fded oa behalf of OSM is rapoase to our appeal <br />The Office of Surface Mining has been a party to alf matters referenced above <br />before the Interior Board of Land Appeals, thuefore, the FOIA exemption for <br />deliberative privilege would not apply. <br />I believe that this material and request would fall under reasonable definition of <br />public interest and therefore ua requesting that all costs be waived. <br />If you deny all or any portion of this request, please advise my Houston office in <br />writing of the specific exemption you believe justifies your refusal to release the objected <br />to material. Advise the name otthe individual responsible for each objection, and notify <br />me of the appeal procedura available wader the 4w. <br /> <br />
