As you can see by the enclosed copy of his response, both the
Office of Surface Mining and the State of Colorado's Division of Minerals and Geology have
looked into this issue, with efforts dating back to 1993.
Ms. Tatum has alleged damages from the Basin Resources' Golden Eagle coal mine, a mining
operation validly permitted by the State of Colorado. Over three years ago, on September 28,
1995, the Office of Surface Mining concluded the Tatum house was not located within an area
where subsidence could be attributable to the Golden Eagle mine. The Tatums on October 12,
1995, filed an appeal with the U.S. Department of Interior Board of Land Appeals. The Board
has not yet issued its decision.
If our agency can provide additional information, please call me on 202-208-4006 or your staff
may call James Fulton, Chief, Denver Field Division, on 303-844-1424. Our people would be
pleased to brief you or your staff on this issue. If you are interested, Mark Oliver, our
Congressional Liaison Officer, will be happy to make the arrangements. He can be reached on
202-208-2838.
,~ Respectfirlly yours,
Kathy Karpan
Director
.%
Enclosure
