CO 81503 <br />Re: Relevant showing of road construction, design and maintenance to comply with Section <br />4.03.1(d)(ii) and 4.03.2(1)(f)(ii) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining. *REVISION 3* <br />Dear Dan: <br />The purpose of this letter is to provide a relevant showing that the herein mentioned travelways <br />that meet the DMG's definition of Road, as described in Section 1.04(111), meet the <br />performance standards of 4.03.1 and 4.03.?. <br />Evidence will not be presented for improvement work on Rio Blanco County Road 65 as it is and <br />always has been a public road since the issuance of this petmit and consequently is specifically <br />excluded from the DMG's definition of "Road" as described in Section 1.04, definition (1 11). <br />Refuse Haul Road <br />Tlie Refuse Haul Road was designed before Colorado gained primacy for surface inspection and <br />therefore the original design and referenced standards aze from 30 CFR part 817. The referenced <br />standards have also been renumbered since that time. To move forward in time to the present, the <br />appropriate Federal standards appear now to be 30 CFR 817.150 and 317.151. The corresponding <br />CMLRB standard is 4.03.1. <br />Through research of the design drawings, verbiage in the Permit documents, maintenance history <br />and visual inspection the refuse haul road appears to be in substantial compliance with the <br />provisions of Rule 4.03.1. <br />
