<br />U.S. DEPARTMENT OF THF, INTERIOR <br />OFFICE OF SURFACE MINING <br />~~,~ RECLAMATION AND ENFORCEMENT <br />NOTICE OF A DECISION AND AVAILABILITY <br />~`~ OF BOTH A TECHNICAL ANALYSIS AND AN <br />ENVIRONMENTAL ASSESSMENT FOR <br />EMPIRE ENERGY CORPORATION <br />PERMANENT PROGRAM PERMIT <br />EAGLE N0. 5 AND N0. 9 MINES <br />HOFFAT COUNTY, COLORADO <br />The United States Department of the Interior, Office of Surface Mining <br />Reclamation and Enforcement (OSM), has approved, with conditions, a <br />5-year permit revision to Empire Energy Corporation's Eagle No. 5 mine to <br />alloy coal mining at the Eagle No. 9 mine. <br />The Eagle No. 9 mine is near their approved Eagle No. 5 mine and both are <br />located in Moffat County, Colorado, approximately 7 miles southwest of <br />Craig, Colorado. The mine has been in operation since 1971. The <br />combined permit area will cover approximately 5570 acres, approximately <br />220 of which have been disturbed to date for surface facilities for the <br />underground operations. Maximum mine production at the Eagle No. 9 mine <br />will be 1.5 million tons of coal per year over 5 years. <br />Aay person with as iaterest which is or may be adversely affected by this <br />Federal permit approval of Eagle No. 9 may request an ad~udicatory <br />hearing on the final decision within 30 days after publication of this <br />notice, in accordance with Section 514(c) of the Surface Mining Control <br />and Reclamation Act (SMCRA). Anq hearing will be governed by provisions <br />of 5 U.S.C. Section 554. Sections 1501.4(c) and 1506.6, notice is hereby <br />given that Colorado Mined Land Reclamation Division has completed a <br />technical analysis (TA) for the permit application package revislon for <br />the Eagle No. 5 and No. 9 Mines, Moffat County, Colorado. OSM has <br />supplemented this TA with its own environmental assessment (EA). OSM's <br />recommendation to approve Empire Energy Corporation's mining plan <br />modification and the permit revision application with conditions is in <br />accordance with Sections 510 and 523 of SMCRA. OSM's analysis is that no <br />significant environmental impacts would result from such approval.
