-26- <br />The applicant originally had not proposed to monitor revegetation success <br />on revegetated surfaces. After discussions with the Division the <br />applicant has proposed an adequate biennial revegetation monitoring plan. <br />Several revegetation plan concerns remained unresolved. These are <br />discussed oelow. <br />The applicant has stated that herbicides and/or pesticides will be used <br />according to extension service recommendations. It is therefore a <br />stipulation to the permit that: <br />Stipulation No. 7 <br />AT LEAST 60 DAYS PRIOR TO USE OF HERBICIDES OR PESTICIDES THE <br />PERMITTEE SHALL SUBMIT A PLAN FOR THE USE OF SUCH CHEMICALS, <br />INCLUDING, AT A IdINIMUM, RATE AND METHOD OF APPLICATION, AND THE <br />NAME OF THE SPECIFIC HERBICIDE AND OR PESTICIDE TO BE USED. THE <br />APPLICANT MUST RECEIVE WRITTEN DIVISION APPROVAL PRIOR TO THE <br />USE OF ANY HERBICIDE OR PESTICIDE. <br />In a discussion of revegetation success criteria to be used to analyze <br />for revegetation success the applicant has proposed criteria based on the <br />methodologies used for the baseline vegetation inventory. In lieu of the <br />number of problems encountered with the baseline methodology the <br />following stipulation is required: <br />Stipulation No. 8 <br />THE PERMITTEE SHALL PROVIDE THE DIVISION WITH A COMPLETE <br />DISCUSSION OF CRITERIA AND METHODS FOR REVEGETATION SUCCESS <br />MONITORING CONSISTENT WITH RULES 4.15.7 AND 4.15.8 WITHIN 9 <br />MONTHS OF PERMIT ISSUANCE. THIS DISCUSSION SHALL ADDRESS COVER <br />AND PRODUCTIVITY, AND WOODY PLANT DENSITY. <br />The applicant has analyzed the baseline vegetation in terms of species <br />diversity. The Division and applicant have discussed species diversity <br />standards and methods of evaluation, but no standard has been set at this <br />time. It is therefore a stipulation to this permit: <br />Stipulation No. 9 <br />THE PERMITTEE SHALL WORK WITH THE DIVISION TO ESTABLISH <br />ACCEPTABLE SPECIES DIVERISTY SUCCESS CRITERIA ANU SAMPLING <br />METHODOLOGY WITHIN 6 MONTHS AFTER PERMIT ISSUANCE. <br />The applicant has submitted information on threatened or endangered plant <br />species at the proposed mine site. No listed or proposed threatened or <br />endangered plant species are present. One listed rare cactus Coryphantha <br />vivipara is found on the proposed permit area. At this time, pursuant to <br />Rule 2.07.6(2)(n) the Division finds that the mining and reclamation <br />activities will not affect the continued existence of any threatened or <br />endangered plant species or result in the destruction or adverse <br />modification of their critical habitats. <br />With the acceptance by the applicant of the above stipulations the <br />proposed operation is in compliance with the requirements of this section. <br />
