-zl- <br />Water pumped from the old workings during future operations will be <br />treated on-site according to Colorado Department of Health standards, <br />then released to the surface water systems. This activity may increase <br />surface water quantities in the immediate area while protecting surface <br />water quality. <br />Coal processing waste and other toxic materials will be backfilled in the <br />pit and covered with at least four feet of non-toxic soil material. This <br />will prevent mixiny of these toxic materials with any surface water <br />supplies. <br />The surface water monitoring plan that is contained as a stipulation in <br />the surface water section of this document will insure that adequate <br />quality and quantity data is gathered over the next year. This <br />information will be used to further insure the protection of the <br />hydrologic balance at the site. <br />The proposed operation is in compliance with the requirements of this <br />section. <br />VIII. Water Rights and Replacement -Rules 2.U4.7(B), <br />2.05.6 3 a) ii iii), 2.07.6 2 c and 4.05.15 <br />The applicant has submitted to the Uivision information dealing with <br />water rights. This information is contained on pages 2.04-46, and <br />2.U5-12, Volume I; in Exhibit lb, Volwne 4; and in the Responses to Uraft <br />Finding Uocument Stipulations Volume. <br />Under a lease agreement with Western States Mineral Corporation, the <br />applicant has obtained the Shafer Water Rights. These rights consist of <br />a 4/30th interest in the Coler Ditch and Reservoir System and 1/2 right <br />to the Coots Spring (3 cfs) water riyhts (Exhibit 16, pages 6 and 7). <br />The applicant has obtained a temporary water right for an industrial well <br />(Case No. 80CWGH, copy in Response Volume). This well will be used to <br />supply water needs at the mine. N11 other wells within one mile of the <br />permit area are either abandoned, owned by the applicant, or will not be <br />impacted by the mining operation. The applicant owns the water rights to <br />the Bechaver, Nrchuleta, Gordon Mine, Bobian and Maitland Windmill wells. <br />The Uivision finds that the proposed mine plan has been designed to <br />prevent material damage to water rights outside the permit area. The <br />mining operation approved under this permit does not include dewatering <br />of old mine workings. Therefore, surface and ground water rights will <br />not be materially damaged. <br />In the future, Colorado Coal Mining Company's life-of-mine plan may <br />entail dewatering of flooded mine workings. The dewatering and the <br />disposition of the water pumped from these workings is presently under <br />study by the applicant and the State Engineer's Office, Division of Water <br />Resources. <br />
