-12- <br />Findings of the <br />Colorado Mined Land Reclamation Division <br />for <br />Colorado Coal Mine No. 1 <br />Explanation of Findings <br />Pursuant to Rule 2. U7.6(2) of the regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining, the Mined Land Reclamation Division or <br />the Board must make a number of written findings prior to the issuance of <br />a permit. These findings are based on information made available to the <br />Division that demonstrates that the applicant will be able to operate in <br />compliance with the Colorado Jurface Coal 14ining Reclamation Act and the <br />regulations promulgated pursuant to the Act. <br />This findings document is organized according to the major disciplines <br />reviewed during the permitting process. The written findings which must <br />be made by the Division are addressed under the appropriate discipline <br />subtitle. For example, findings concerning the protection of endangered <br />or threatened fish and wildlife species will be found under the subtitle <br />of Fish and Wildlife. Also, any specific approvals required to be made <br />by the Division pursuant to Rule 4 and thus requiring a written finding <br />pursuant to Rule 2.U7.6(2)(rn) are discussed under the appropriate <br />discipline subtitle. <br />I. Legal, Financial, and Compliance Information - Rule 2.03 <br />The applicant's section on legal, financial, and compliance information <br />can be found in Volume 1, pages 2.03-1 tnrouyh 2.03-13. <br />The applicant nas identified Chimney Rock Coal Co. as being owned by <br />Pe rna Resources Corp. throuyh JHR Corp., the general partner of Chimney <br />Rock Coal Co. Perna Resources Corp. is the general partner of the <br />applicant (CGMC). Therefore the Division maintains that these two coal <br />mines are both under the control of Perma Resources Corp. and the <br />information required uy Rules 2.03.4(4) and 2.03.5, concerning previous <br />coal mining permits and compliance information must be reviewed for <br />Chimney Rock Coal Co., as well as CCMC. The Division has Bete reined, <br />from information contained in the Chimney Rock Coal Co. file maintained <br />by the Division, No. C-039-81, that Chimney Rock Coal Co. is currently in <br />compliance with the requirements of the Act. <br />Pursuant to Rule 2.07.6(2)(f), the Division has determined that for this <br />operation, private mineral estate has been severed from private surface <br />estate in approximately half of the permit area, however, the surface <br />owner is the mining company. The applicant has supplied the documentation <br />specified by 2.03.6(2). <br />The proposed operation is in compliance with the requirements of this <br />section. <br />
